Ontario Provincial Police say the drivers of several luxury vehicles are facing stunt driving charges after a traffic stop on Highway 400 near the Barrie ONroute service centre Sunday.
OPP Sgt. Kerry Schmidt said the drivers of the vehicles, which include Lamborghinis, Ferraris, and Porsches, were spotted driving "erratically" along the highway.
Schmidt said officers responded to the scene and pulled the vehicles over.
We’ve got a whole line of cars right now being impounded. Drivers are getting their licences suspended," Schmidt told CP24 Sunday afternoon.
"That kind of aggressive driving (is) the leading cause of death and injury. We do not want people using highways as their little playground racetracks."
Schmidt said the drivers will all face stunt driving charges following the incident.
"They are not going to be arrested per se but they will all lose their driver's licences for one week and their vehicles are all being impounded for seven days as well,” Schmidt noted.
“They will have to speak to a judge to determine what monetary penalties will be on that.”

Whether the charges were warranted or not, something like this is not good for future car club cruises. It's only the first nice day this year and we have this. Yikes.

^What a joke! They have no video or radar of these cars, just drivers calling in saying they were speeding? What a joke! How the eff can that charge possibly stick? I'd be embarrassed to be a cop with these stupid laws.

People hear a loud exhaust and jump to conclusions, happens all the time driving my fox around the city. I had a cyclist pull up to me at a red last summer telling me to "take it easy bud this isn't a race track"

(13) There is no appeal from, or right to be heard before, a vehicle detention, driver’s licence suspension or vehicle impoundment under subsection (5), (6) or (7), but this subsection does not affect the taking of any proceeding in court. 2007, c. 13, s. 21.

Total BS. None of these witness statements should hold up in court. Thinking someone is going to fast is not evidence.

Seems the cops can do what ever the hell they want, I wouldn't even care about the fine it's more my car being towed then impounded for a week in a shady yard

Perhaps there was a whole bunch of ridiculous stuff going on but on the surface it sounds similar to this from a few years back.


Every year, the Southern Ontario Mini (http://www.autoblog.com/make/mini/) Club organizes two charity drives – one in the Spring and one in the Fall. Over time, the event has grown from a handful of participating cars to over 30, and as such, this year the organizers let local law enforcement (http://www.autoblog.com/2010/03/26/report-california-scraps-cool-cars-legislation-automakers-l/) know where the caravan would be and when it would be there as a courtesy. So far, so good, right? Not exactly.

During the first part of the drive, the convoy ran into a few members of the Ontario Provincial Police (http://www.autoblog.com/2010/03/26/video-dog-rips-off-police-cruisers-bumper-with-teeth-wins-fri/) without incident. One officer even went so far as to tell the organizers that there was only one other patrol for the rest of the route. Turns out that wasn't quite true.

Instead of providing an escort for the convoy or thanking the organizers for a heads up, the OPP set up a speed trap (http://www.autoblog.com/tag/speed+trap/) along the route where the limit changes from 100 km/h to 90 km/h. When the parade of Minis came past, officers pulled over the whole lot, and cited three cars for going 121-123 kmh in a 90 kmh zone, or about 76 in a 55. One driver was also cited for having a radar detector and had his equipment confiscated.

Yes, setting up a speed trap on a charity (http://www.autoblog.com/2010/02/24/german-charity-execs-in-hot-water-over-luxury-car-ownership/) drive is a prick move, but it gets worse. The OPP evidently called the local television station beforehand so they could film the whole sting. Once the station had the film, they broadcast a story claiming that 11 of the Mini drivers had been arrested for doing 50 kmh over the speed limit and that they had their vehicles confiscated as a result. Even worse, the story claimed that some of the Mini drivers had their children with them and that the OPP had called the Canadian equivalent of child services on the parents.

Members of the Mini club complained to the station, and the video was taken down as a result, though no apology or retraction has been issued so far.

You can guarantee, at least some have the means to show up with a lawyer and will document any and all damage before moving their rides so much as an inch. Operators will want to have documentation with pics or video proof before they moved the towed vehicles so much as an inch from where they were hooked up.

I wish when they are found innocent they could turn around and sue the province. That would put an end to this bullshit law. This whole thing smells like shit.

This is what makes my blood absolutely boil. Nothing like roadside trial and sentencing from which you have no actionable recourse. All because someone "says" you were in contravention of this stupid goddamn law. I said this when it first came out and every non car person I know said "oh they won't enforce it based on peoples calls you're being dramatic". Well, it has and continues to happen.

I do not care a single bit what these drivers were seen by motorists allegedly doing, among the basis of the justice system is burden of proof and hearsay isn't proof.

I think they pulled over more than they actually ticketed so perhaps they have hard evidence like radar or pacing for the ones they did actually ticket? Non-police witnesses won't stand up in court so the police would be stupid to take action on a group this big based on hearsay and risk it going to court IMO. If they don't then that's an issue and I hope there is enough anger (and deep pockets) to seek recourse - may need to get legally creative to do so but targeted as a group versus individual might be an interesting twist. This law is stupid anyways.....

True but this isn't one cop - it's a group and probably supervisors involved, and they know these guys are going to lawyer up...so I would hypothesize that they have more than other non-police drivers' accounts of speed (which is easy to argue would not be accurate and therefore unusable evidence), and would be smart enough to think that this could be a PR nightmare is they don't have their collective act together.

Just saying that an enforcement action this "big" without real evidence (ie. radar, etc) would be a huge mistake, and given the number of officers and their supervisors involved I would be surprised if they didn't have any police-based evidence that is supportable. Just the ensuing court process and time involved (police, court resources, etc) when the lawyers all get involved will get very expensive and if any of these guys are politically connected there will be blow back. I'm not even bothering with media comment sections because those same people condemning these drivers have probably checked text messages or used their phone in their cars, or ate while driving, etc.

There is a lot of resentment toward this law, but how many of us have contacted our MPP to voice our displeasure? I would bet that on this board alone it is fewer than the 12 that just got dinged. And for the record, I have not.

The problem is that this has been taken to court and has been upheld IIRC - based on that I don't know if either party would bother rolling it back. If it had failed in court then they would have to do something but I don't know if 100% of them are thrown out.

I met with Sylvia... I gave her an entire presentation that included a handout/booklet that I made. (I mailed one to Tim).

The thing to remember is politicians are opportunists and HTA 172 will have more support than not because most people are not enthusiasts. Most people just hear 'racing' and think that any law to prevent it is good. Many more think 'oh well, that person must have deserved it'.

Remove due process... No problem. Raise Hydro rates... WHOA! OUTRAGE. This is Liberal Ontario.

I called Frank Klees on the phone when he initially proposed it in early 2006...before that couple got killed by "street racers" in his riding

Met in person with my douchebag Liberal MPP to discuss my thoughts on the Bill in which he said he would investigate and represent my concerns to the Legislature, and then a follow up meeting where he bullshitted me to my face....he did nothing and I basically called him on it

started an online petition

was interviewed by Global TV

and when it was obvious these fuckers were making the law.... and after the details of the court case against the "street racers" in Frank Klees' riding came out.... with the judge saying the kids weren't racing and that the dead driver was shitfaced at twice the limit....I called him a fucking liar while he threatened me with legal action

and all that did sweet fuck all

this law is never changing so don't bother wasting your time and effort dealing with these fucker politicians....it will only make you more angry when they respond to your face with bullshit party-approved talking points

only thing I hope is that those who think this law is awesome...get busted by it
